Coverage for Dependents to Age 26

Group Health Plans must start offering coverage to employee's children up to age 26.  The children do not have to live with the employee, rely on the employee for support, a student or included on the employee's tax return.  This requirement is valid and is extended to those children who are not eligible for coverage under another employer's plan, including their spouse.  This requirement will be dropped beginning in 2014.

Currently, most insurers are implementing this well in advance of the September 23, 2010 deadline.  If you are unsure, please contact our office.  In order to add the child to the employee's coverage, a qualifying event must occur or this may be done during open enrollment.

The big question is, how do you substantiate that the employee's child is not eligible for other employer health care coverage?
